Terms of Use

These Terms of Use ("Terms") govern your access to and use of JapanPlan AI (the "Service"), operated by tinkrbox ("we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

JapanPlan AI is an informational travel-planning tool that uses artificial intelligence and curated templates to suggest itineraries, destinations, activities, transport notes, camping stops, seasonal tips, and related travel ideas for Japan. The Service is provided for personal, non-commercial use unless we agree otherwise in writing.

2. Not professional advice

Content generated or displayed by the Service — including AI chat replies, itineraries, prices, travel times, JR Pass notes, camping locations, seasonal forecasts, maps, weather notes, and safety or logistics tips — is for general informational purposes only. It is not legal, medical, safety, immigration, insurance, financial, or professional travel advice. Always verify information with official sources, local authorities, transport operators, campgrounds, hotels, and your own judgment before you travel or make bookings.

3. Accuracy and changes

Travel information changes frequently. Opening hours, prices, transport schedules, road conditions, overnight parking rules, cherry blossom / foliage timing, festivals, and facility availability may be wrong, incomplete, or out of date. AI systems can produce incorrect or invented details ("hallucinations"). You are solely responsible for confirming all plans before relying on them.

4. Your responsibilities

You must be at least 16 years old (or the age of digital consent in your region).
You are responsible for your account credentials and for activity under your account.
You must not misuse the Service (including scraping, reverse engineering, abusing AI endpoints, attempting unauthorized access, or uploading unlawful or harmful content).
You must not submit sensitive personal data of others without permission, or content you do not have rights to share.
You are responsible for visas, entry requirements, travel insurance, health precautions, driving licenses, vehicle rentals, camping regulations, and compliance with local laws.

5. Accounts and guest use

You may use the Service as a guest or with an account. Guest trips may be limited, lost, or deleted. We may suspend or terminate accounts that violate these Terms or that present security or abuse risks.

6. Third-party services

The Service may rely on third parties such as hosting providers, databases, authentication (e.g. Supabase), AI model providers (e.g. via OpenRouter), maps, analytics, and email delivery. Their terms and privacy practices also apply. We are not responsible for third-party outages, content, or decisions.

7. Intellectual property

The Service, branding, software, and original materials are owned by tinkrbox or its licensors. You retain rights to the trip preferences you enter. By using the Service, you grant us a limited license to process that content solely to operate and improve the Service. You may not copy, resell, or redistribute the Service or its outputs as a competing product without permission.

8. Shared links

If you create a shareable trip link, anyone with that link may view the itinerary. You are responsible for deciding what to share and with whom.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ITINERARIES OR AI OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR TRAVEL.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINKRBOX AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR TRAVEL COSTS, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE — INCLUDING RELIANCE ON AI ITINERARIES, MISSED CONNECTIONS, BOOKING ERRORS, CAMPING OR ROAD CONDITIONS, INJURY, OR PROPERTY DAMAGE — WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100) IF YOU HAVE NOT PAID US.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by applicable law.

11. Indemnity

You agree to indemnify and hold harmless tinkrbox from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your travel decisions, your content, or your violation of these Terms or applicable law.

12. Changes and availability

We may change, suspend, or discontinue any part of the Service at any time. We may update these Terms by posting a revised version with a new "Last updated" date. Continued use after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules, except where mandatory consumer protections in your place of residence apply. Courts in Japan shall have exclusive jurisdiction over disputes arising from these Terms, subject to any non-waivable rights you may have.
